AVA-Shops — TERMS OF SERVICE / TERMS OF USE / EULA

Welcome to AVA-Shops ("AVA-Shops," "we", "us", or "our"). These Terms of Service ("Terms") govern your use of the AVA-Shops website, Progressive Web App (PWA), browser extension, mobile app, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Terms of Use / EULA
The following terms apply to your use of AVA, including subscriptions purchased through the Apple App Store:
AVA provides shopping assistance, product discovery, cart management, checkout assistance, and commerce automation tools.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Payment is charged to the user’s Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off in App Store settings.
Users can manage and cancel subscriptions through Apple App Store account settings.
AVA is provided “as is” without warranties of uninterrupted availability.
AVA is not responsible for third-party merchant pricing, availability, shipping delays, or retailer website changes.
On iOS, in-app subscriptions and credit packs are billed through Apple. Web and extension purchases may use other payment providers as described elsewhere in these Terms.
Apple Subscription Terms
Subscription products may automatically renew unless canceled at least 24 hours before the end of the current billing period.
Payment will be charged to the user’s Apple ID account at confirmation of purchase.
The account will be charged for renewal within 24 hours before the end of the current billing period.
Users can manage and cancel subscriptions through Settings → Apple ID → Subscriptions (Apple Account Settings) after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when a subscription is purchased.
Subscription pricing and durations are displayed within the application and on the App Store product page.
Apple Standard EULA
AVA is licensed to users under these Terms of Service and, where applicable, Apple’s Standard Licensed Application End User License Agreement.
You must be at least 13 years old and capable of entering legally binding agreements to use the Service.
2. DESCRIPTION OF SERVICE
AVA-Shops provides an AI-powered shopping assistant that helps users:
Discover products
Compare options
Navigate retailer websites
Add products to cart
Initiate and assist with checkout flows you confirm
Use guided or accelerated checkout modes
Access potential subscription-based features or usage credits
AVA does not sell products directly. All purchases occur directly through third-party retailers.
AI LIMITATION CLAUSE
AVA-Shops is an AI-powered shopping assistant that helps streamline product search and checkout on supported sites.
By using AVA-Shops, you acknowledge that:
Results may not always be accurate, complete, or up-to-date
Product selection, pricing, availability, and checkout behavior may vary
Assisted actions are performed based on interpreted input and may not always reflect user intent perfectly
AVA-Shops does not guarantee error-free operation.
Users are responsible for reviewing final checkout details before confirming a purchase.
Payments for subscriptions, credits, and usage are for access to the platform and its features, not for guaranteed outcomes or results.
SUPPORTED PLATFORMS
AVA-Shops checkout-assistance features currently operate only through the official AVA-Shops Chrome Extension on desktop versions of Google Chrome.
Mobile browsers, mobile webviews, Progressive Web Apps (PWA) without the Chrome extension, Safari, Firefox, and other browsers may not support the same checkout-assistance features.
Users acknowledge that certain checkout-assistance features, including guided checkout and assisted on-page steps, may not function outside supported desktop environments.
We do not guarantee feature parity across devices or platforms.
3. USER AUTHORIZATION FOR CHECKOUT ASSISTANCE
By using the Service, you explicitly authorize AVA to:
Open retailer pages in new or existing tabs
Navigate retailer checkout flows
Detect checkout states (e.g., cart, Prime upsell, final checkout)
Click buttons necessary to complete user-initiated actions
Submit checkout forms upon your explicit confirmation
Execute assisted checkout flows within supported retailer domains
You acknowledge and agree:
All purchases are final once submitted to the retailer.
You are responsible for verifying cart contents, shipping details, payment methods, and pricing.
AVA does not control retailer pricing, inventory, taxes, shipping fees, or order fulfillment.
Checkout assistance relies on third-party website structures, which may change without notice.
Retailer website changes may cause checkout-assistance errors or unintended behavior.
You assume responsibility for monitoring checkout steps and confirming orders.
4. CHECKOUT ASSISTANCE RISK ACKNOWLEDGMENT
You understand that:
AVA relies on retailer website layouts and button structures.
Retailer updates may cause mis-clicks, incorrect quantity selection, or unintended navigation.
Checkout assistance may malfunction due to browser changes, extension updates, or retailer changes.
AVA cannot guarantee perfect detection of all checkout states.
You use checkout-assistance features at your own risk.
5. EXPRESS MODE (ACCELERATED CHECKOUT)
Express Mode (when enabled in the future) will always require explicit user opt-in activation.
Express Mode may streamline checkout steps after you confirm, with fewer intermediate prompts before you place the order.
Users accept full responsibility for all completed transactions initiated through Express Mode.
Express Mode can be disabled at any time.
6. AFFILIATE DISCLOSURE
AVA participates in affiliate programs, including but not limited to Amazon Associates and other retailer programs.
As an Amazon Associate, AVA earns from qualifying purchases.
When applicable, affiliate tracking parameters may be appended to supported retailer product URLs. This does not increase the price you pay.
AVA may receive commissions if you complete qualifying purchases through supported links.
7. PAYMENTS, SUBSCRIPTIONS & CREDITS
Certain features may require:
Subscription plans
Usage-based credits
Paid tiers
Express Mode unlock access
If activated:
Payments are processed by third-party payment providers.
AVA does not store full credit card numbers.
Credits may be non-refundable except where required by law.
Credits may expire depending on plan structure.
AVA may revoke credits obtained through fraud or abuse.
Our systems may detect abuse, fraud, or policy violations.
AVA reserves the right to suspend accounts for misuse.
Plans, pricing, and feature access may change at any time.
Credits may be spent on assisted search, cart, checkout, and related automation features. Guided and Express subscription plans may include included usage runs or credits per billing cycle as shown at purchase. Purchased credit packs add to your balance until used or forfeited as described below.
ACCOUNT DELETION
You may delete your AVA-Shops account at any time through the in-app flow: open the credits and plans screen, then Settings → Account → Delete Account, and confirm deletion.
Account deletion is permanent and cannot be undone. Deletion may result in immediate loss of:
Remaining credits, trial runs, and Express or Guided subscription benefits on our systems
Saved sessions, cart state, personalization, and per-user search resume data tied to your account
Account recovery via prior email-restore credentials for that deleted account
Active Stripe subscriptions linked to your account are canceled as part of deletion. This is separate from choosing Manage Billing to cancel at period end (see Subscription, Credits, and Cancellation below).
Some billing and transaction records may be retained or anonymized where required for tax, accounting, fraud prevention, or legal compliance. See our Privacy Policy for details.
REFUND POLICY
Effective Date: April 5, 2026
Thank you for using AVA-Shops.
1. Subscriptions
AVA-Shops offers subscription-based access to premium features.
Payments are processed via Stripe.
2. Refunds
All subscription payments are generally non-refundable.
However, refunds may be granted in the following cases:
Duplicate charges
Billing errors
Technical issues that prevent access to paid features
Requests must be submitted within 7 days of the charge.
On iOS, cancel through Settings → Apple ID → Subscriptions in the App Store.
On web, cancel through Manage Billing (Stripe Customer Portal) as described below.
Cancellation stops future billing.
You will retain access until the end of the billing period.
No partial refunds for unused time except as stated in the Refund Policy or required by law.
5. Third-Party Purchases
AVA-Shops does not handle product purchases.
All product-related refunds, returns, or disputes must be handled directly with the retailer.
6. Changes to Refund Policy
We reserve the right to update this refund policy at any time.
Continued use of the Service constitutes acceptance of any updates.
8. USER RESPONSIBILITIES
You agree not to:
Use the Service for fraudulent or unlawful activity.
Attempt to bypass usage limits or paywalls.
Interfere with retailer systems.
Reverse engineer or exploit the Service.
Use the Service to manipulate retailer pricing or inventory systems.
Violation may result in suspension or termination.
9. THIRD-PARTY RETAILERS & SUPPORTED RETAILERS
Checkout assistance is currently limited to supported retailer domains. At this time, Amazon.com is the primary supported retailer for assisted checkout.
Other retailers may be referenced for informational or search purposes only and may not support assisted checkout.
Supported retailers may change at any time without notice.
AVA is not affiliated with or endorsed by any retailer unless explicitly stated.
We are not responsible for:
Product defects
Shipping delays
Retailer payment failures
Returns or refunds
Order cancellations
Warranty disputes
All purchase disputes must be resolved directly with the retailer.
10. DISCLAIMER OF WARRANTIES
The Service is provided "AS IS" and "AS AVAILABLE."
AVA makes no warranties regarding:
Continuous availability
Retailer stock accuracy
Pricing accuracy
Error-free operation
Compatibility with all retailer changes
Use at your own risk.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
AVA shall not be liable for:
Indirect or incidental damages
Lost profits
Retailer errors
Assisted-checkout outcomes
Unauthorized purchases resulting from user account compromise
Total liability shall not exceed the amount paid to AVA in the preceding 3 months.
12. INDEMNIFICATION
You agree to indemnify and hold harmless AVA, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:
Your misuse of the Service
Your violation of these Terms
Purchases completed through your account
Fraudulent or unlawful use of checkout-assistance features
13. SERVICE MODIFICATION OR TERMINATION
AVA reserves the right to modify, suspend, or discontinue any part of the Service at any time without liability.
You may terminate your relationship with AVA by deleting your account through the in-app deletion flow described in Account Deletion above.
14. DISPUTE RESOLUTION & ARBITRATION
Any dispute shall be resolved through binding arbitration in the State of Texas, unless prohibited by law.
You waive the right to participate in class-action lawsuits.
15. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, United States.
Subscriptions are billed on a recurring monthly basis beginning on the date of purchase. Your subscription will automatically renew at the end of each billing cycle unless canceled prior to renewal.
Credit Allocation and Reset
Each subscription includes a fixed number of usage credits per billing cycle.
Credits are granted at the beginning of each billing cycle.
Credits reset at the start of each new billing cycle.
Any unused credits from the previous cycle are permanently removed and do not carry over.
Cancellation Policy
You may cancel your subscription at any time.
On the AVA iOS app, manage or cancel through Apple App Store account settings (Settings → Apple ID → Subscriptions).
On web, use the "Manage Billing" feature (Stripe Customer Portal).
Cancellation through Manage Billing typically takes effect at the end of the current billing period unless otherwise shown in the portal.
You will not be charged for the next billing cycle after cancellation is processed.
No refunds are issued for unused time or unused credits except as stated in the Refund Policy.
Post-Cancellation Access
After cancellation:
You retain access to subscription features until the end of the current billing period.
Remaining credits may be used until the billing period ends.
All unused credits expire at the end of the billing period.
Billing Management
All billing is securely handled by Stripe. AVA-Shops does not store or process payment card information.
