Welcome to AVA-Shops ("AVA-Shops," "we," "us," or "our"). These Terms govern your use of the AVA-Shops website, Progressive Web App (PWA), Chrome Extension, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. ELIGIBILITY
You must be at least 13 years old and capable of entering legally binding agreements to use the Service.
2. DESCRIPTION OF SERVICE
AVA-Shops is an AI-powered shopping assistant that helps users:
- Discover products
- Compare options
- Navigate supported retailer websites
- Add items to cart
- Initiate or streamline checkout flows (guided or faster modes, with your confirmation)
AVA-Shops does not sell products. All purchases are completed directly with third-party retailers.
Currently, assisted shopping features work best on desktop with the Chrome extension and on supported retailer domains. Mobile experience may vary.
3. USER AUTHORIZATION FOR ASSISTED SHOPPING
By using AVA-Shops, you authorize the Service to:
- Open supported retailer pages
- Detect checkout states (cart, upsell pages, final checkout)
- Click buttons required to complete actions you initiate
- Submit checkout forms only after your explicit confirmation
WAKE WORD FEATURE
If you enable the wake word feature, you authorize AVA-Shops to listen locally for the activation phrase ("Ava") while the AVA-Shops tab is open and active. AVA-Shops will only act after activation. You can disable wake word at any time.
You acknowledge and agree:
- Purchases are final once submitted to the retailer
- You are responsible for verifying cart contents, shipping details, payment methods, and pricing before confirming
- AVA-Shops does not control retailer pricing, availability, fulfillment, or returns
- Retailer website changes may affect how the assistant behaves on those pages
4. ASSISTED SHOPPING RISK
AVA-Shops relies on third-party retailer layouts and site structures. Retailer updates may cause errors, mis-clicks, or unintended behavior. AVA-Shops cannot guarantee perfect detection or checkout accuracy. Use of these features is at your own risk.
5. EXPRESS MODE
If Express Mode is enabled:
- You explicitly opt in to accelerated checkout after you confirm
- AVA-Shops may complete checkout steps you approve without extra on-screen prompts
- You accept full responsibility for completed transactions
- AVA-Shops is not liable for pricing changes, stock changes, retailer errors, or timing of assisted steps
Express Mode always requires explicit activation and may be disabled at any time.
6. AFFILIATE DISCLOSURE
AVA-Shops participates in affiliate programs, including Amazon Associates.
As an Amazon Associate, AVA-Shops earns from qualifying purchases.
Affiliate parameters may be appended to supported retailer product URLs. This does not increase the price you pay.
7. PAYMENTS, SUBSCRIPTIONS & CREDITS
Certain features may require subscriptions, credits, or paid tiers.
- Payments are processed by third-party providers
- AVA-Shops does not store full card numbers
- Credits may be non-refundable except where required by law
- Credits may expire depending on plan structure
- Accounts may be suspended for fraud, abuse, or misuse
- Plans and pricing are subject to change
REFUND POLICY (summary)
Subscription payments via Stripe are generally non-refundable; we may refund duplicate charges, billing errors, or technical loss of paid access if you contact support@ava-shops.com within 7 days of the charge. Cancel anytime—future billing stops; access continues through the paid period; no partial refunds for unused time. Retailer product refunds are only with the retailer. Full policy: Refunds and Terms.
8. USER RESPONSIBILITIES
You agree not to:
- Use the Service for fraud or unlawful activity
- Bypass usage limits or safeguards
- Interfere with retailer systems
- Reverse engineer or exploit the Service
Violation may result in suspension or termination.
9. THIRD-PARTY RETAILERS
AVA-Shops is not affiliated with or endorsed by retailers unless explicitly stated.
AVA-Shops is not responsible for:
- Product defects
- Shipping delays
- Retailer payment issues
- Returns, refunds, cancellations
- Warranty disputes
All disputes must be resolved directly with the retailer.
10. DISCLAIMER OF WARRANTIES
The Service is provided "AS IS" and "AS AVAILABLE."
AVA-Shops makes no warranties regarding:
- Continuous availability
- Pricing accuracy
- Retailer stock accuracy
- Error-free operation
- Compatibility with all retailer layouts
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
AVA-Shops shall not be liable for:
- Indirect or incidental damages
- Lost profits
- Retailer errors
- Checkout outcomes on retailer sites
- Unauthorized purchases resulting from user account compromise
Total liability shall not exceed the amount paid to AVA-Shops in the preceding three (3) months.
12. INDEMNIFICATION
You agree to indemnify and hold AVA-Shops harmless from claims arising from:
- Misuse of the Service
- Violation of these Terms
- Purchases completed through your account
- Fraudulent or unauthorized use
13. SERVICE MODIFICATION
AVA-Shops may modify, suspend, or discontinue any part of the Service at any time.
14. DISPUTE RESOLUTION
Any dispute shall be resolved through binding arbitration in the State of Texas, unless prohibited by law. You waive the right to class-action lawsuits.
15. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, United States.

Privacy Policy

1. Overview — AVA-Shops helps you search, compare, and streamline checkout on supported sites. The fullest assisted-checkout experience is primarily available via the desktop Chrome extension; other surfaces may vary.
2. Information we collect — (a) What you provide: searches, voice (if enabled), optional wake word while active, cart/checkout actions, account/waitlist email, subscriptions, optional image/camera search, referrals. (b) Automatic: usage events, device/browser info, session and pseudonymous IDs, credits/usage, coarse region signals, hashed IPs for abuse prevention, diagnostics, limited analytics. (c) On supported shopping sites: product page data and interactions needed for cart/checkout you request. We do not collect full card numbers, CVV, or retailer passwords.
3. How we use data — Search and matching, pricing display, actions you request, subscriptions/credits, reliability, analytics in aggregated or pseudonymous form, security, and legal compliance.
4. Sharing — We do not sell personal data. We may share limited data with hosts, Stripe, AI/infrastructure providers, retailers as needed for actions you direct, affiliates for commission reporting, and authorities if required.
5. Payments — Stripe (or designated processor) handles cards; we may receive billing metadata only. Retailer purchases are paid on the retailer; we may see masked hints (e.g., last digits) to confirm your choice.
6. Retention — Much data is ephemeral; sessions/preferences may persist locally; logs for a limited period; billing as required by law. Processing may occur in the U.S. and where providers operate.
7. Permissions — Sites access, storage, microphone (if used), camera/media only if you use visual search.
8. Security — HTTPS, rate limits, access controls, validation of client/server traffic.
9. Your choices — Adjust mic/camera in the browser; disable wake word; remove extension or clear data; contact us for privacy requests.
10. Children — Not directed at children under 13; Terms require 13+.
11. Changes — We may update this policy; continued use may constitute acceptance.
